Sales conditions

ARTICLE 1. SUBJECT

The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these terms and conditions of sale.

AS’ART reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

 

ARTICLE 2. COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

All the texts and images presented on the AS’ART website are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden.

 

ARTICLE 3. PERIOD OF VALIDITY OF SALES OFFERS

In the event of an order for several products, one or more of which have a delivery time indicated on the product sheet, the entire order will be shipped by default at the end of this delivery time.

In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail or telephone of the delivery of a partial order or the cancellation of the order. A product substitution may be proposed to the customer, often by telephone; in case of absence, an email will then be sent. If the debit has already taken place at the time of the information given on the unavailability of the product, a request for reimbursement of the sums involved is made: an email is then sent to the customer on this subject. Following this request, the period for which the bank account is credited is 14 days according to the law in force.

 

ARTICLE 4. PRODUCT PRICES

Prices are indicated in euros, all taxes included, excluding shipping costs. The amount of the shipping costs appears on the screen at the end of the selection of the different products by the customer.

The prices indicated do not include the costs of order processing, transport and delivery provided that they take place in the geographical areas provided for below.

AS’ART may modify its range of products and price list at any time, without this modification affecting orders that have been previously confirmed.

 

ARTICLE 5. ORDER

By clicking on the “Order” button during the ordering process, the customer declares that he/she fully and unreservedly accepts all the present General Terms and Conditions of Sale. The data recorded by www.asart.fr constitutes proof of all transactions between www.asart.fr and its customers. www.asart.fr will systematically confirm your order and then its dispatch by email.

 

ARTICLE 6. TERMS OF PAYMENT

Payment for purchases is made in two ways, by bank transfer to the Caisse d’Epargne account or by credit card with STRIPE or by Paypal.

 

ARTICLE 7. DELIVERY

The products will be sent to the delivery address indicated by the buyer during the ordering process, only within the agreed geographical area. The participation in the processing and shipping costs is inclusive of all taxes.

 

AS’ART delivers packages anywhere in metropolitan France and to European Union countries.

The risks are borne by the purchaser from the moment the products have left AS’ART’s premises.

Delivery costs are calculated according to 3 geographical areas:

– Metropolitan France: A minimum delivery charge of 5€, beyond this the delivery charges are 5% of the total amount of the products, including all taxes.

– Border and neighbouring countries: A minimum delivery charge of 12€, over and above this the delivery charge is 10% of the total amount of the products, including VAT (Belgium, Spain, Italy, United Kingdom, Netherlands, Germany, Luxembourg, Portugal).

– Scandinavian countries and the rest of Europe: minimum delivery charge of 25€, beyond that the shipping costs are 20% of the total amount of the products, including tax.

 

ARTICLE 8. SHIPPING TIMES

The delivery times correspond to the processing and delivery times, themselves calculated according to the date of receipt of the goods. These times also vary according to the destination and do not include public holidays and weekends. As from the exercise of the right of cancellation, AS’ART will reimburse the amount within 14 working days.

In case of partial delivery, this right will only concern the undelivered balance of the order.

Each delivery is deemed to be made as soon as the product is made available to the client by the carrier, as evidenced by the control system used by the carrier. It is the recipient’s responsibility to check shipments on arrival and to make any reservations and claims that appear justified, or even to refuse the package if it is likely to have been opened or if it bears obvious signs of deterioration. The said reservations and complaints must be sent to the carrier by registered letter with acknowledgement of receipt within three days of receipt. a copy should be sent to contact@asart.fr.

If the products delivered do not comply in kind or in quality with the specifications indicated in the delivery note, the customer must, on pain of forfeiture, make his complaints within eight days after delivery.

 

ARTICLE 9. CUSTOMER RELATIONSHIP / SAV

In case of delay, breakage, missing or for any other question, the customer can contact the team from Monday to Friday, from 10:00 am to 5:00 pm on 03 60 47 00 16 or by email: contact@asart.fr.

 

ARTICLE 10. RIGHT OF WITHDRAWAL

All products sold benefit from the “satisfied or reimbursed” clause for 14 days from the date of delivery in accordance with the provisions of the French Consumer Code, article L 121-21, provided that the product has not suffered any damage and is in its original packaging.

The return will be made to the following address, unless otherwise specified:

Refunds to the customer will be made within 14 days of receipt of the goods as a result of exercising the right of withdrawal.

The right of retraction is also exercised as soon as the order is placed and before the logistical processing of the package. In this case, the order is simply cancelled.

No cash on delivery return will be accepted for any reason whatsoever.

This right of retraction can never be exercised if the products delivered have obviously been used for a long time (more than a few minutes).

The products must be returned properly protected, in their original packaging, in perfect condition for resale (undamaged, damaged or soiled by the customer) accompanied by any accessories, instructions for use and documentation to the address indicated above, accompanied by the original sales invoice, of which the customer will keep a copy.

Packages for which no information is provided to identify the sender (order number, e-mail, surname, first name, address) will not be accepted.

In the case of a bulky object, the object must be packed in the same way as when it was delivered, on a pallet if it was delivered in this way.

The costs and risks related to the return of the product are the responsibility of the sender.

 

ARTICLE 11. LEGAL GUARANTEE FOR HIDDEN DEFECTS

All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In the event of hidden defects in a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it.

 

ARTICLE 12. LIABILITY

The seller, in the process of selling online, is only bound by an obligation of means; its liability cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

 

ARTICLE 13. INTELLECTUAL PROPERTY

All elements of the AS’ART website are and remain the exclusive intellectual property of AS’ART. No one is authorised to reproduce, exploit, redistribute or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly prohibited without the express written consent of AS’ART.

 

ARTICLE 14. PERSONAL DATA

In accordance with the French Data Protection Act of 6 January 1978, amended in 2004, you have the right to access and rectify any information concerning you, which you can exercise by contacting us by enclosing a copy of your identity document by post: AS’ART, 8 rue de Beaumarais, 60129 Glaignes.

Finally, you also have the possibility to unsubscribe from the newsletters offered by www.asart.fr by clicking on the link at the bottom of the page in the last newsletter you received.

Your bank details are never in our possession. Transactions are entirely processed by Stripe, Paypal or our bank.

 

ARTICLE 15. ARCHIVING

AS’ART will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code. AS’ART’s computerised registers will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

 

ARTICLE 16. LIABILITY – DISPUTES – APPLICABLE LAW

AS’ART cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of the postal services and means of transport and/or communications, flood, fire.

In the event of a dispute, the customer should first contact www.asart.fr to obtain an amicable solution. By default, only the courts of Paris are competent, regardless of the place of delivery and the methods of payment accepted.

These general terms and conditions of sale in French will be executed and interpreted in accordance with French law. Any dispute that may arise in connection with its validity, interpretation or execution will be submitted to the Courts of Paris, which are expressly attributed exclusive jurisdiction.

AS’ART reserves the right to modify the general terms and conditions of sale. Clients who do not wish their contractual relations to be governed by the new version of the general terms and conditions of sale, must notify AS’ART and, from the date on which the new version takes effect, they must cease using the services www.asart.fr. In the event that any of the terms of the general conditions of sale are considered illegal or unenforceable by a court decision, the other provisions will remain in force.
